ENFORCEMENT NOTES - FALL 2007 A clear summer and good weather into the fall meant that the traffic ticket enforcers have had a lot of time to write summonses. The changes in prosecution for State Police officers (only NYSP) have taken root and most towns and cities have established a system to deal with NYSP tickets. There are still a very few towns where "plead as charged or go to trial" is the rule, but they are few. These are also towns where the Town Supervisor has had a conversation with the Judge, as to the Justice Court revenues being off, as Towns do rely upon Justice Court money - it's not just "urban legend". Our office is fully familiar with the system in each Town, which can often vary quite a bit. Good weather always brings out the lasers and radars. There are fewer "details" (cop speak for mass production radar traps) than in the past, though, as there is no overtime money to be spent and the changes in State Police prosecution have removed the incentive to write tickets, as the overtime they used to get for the tickets is now gone. Still, they are out there, and a wise driver remains paranoid. Ka band radar (Stalker Dual, hard mounted front and rear in each car) is the weapon of choice, followed by Laser, mostly used in good weather. The Law Offices of Casey
